Coffee Cup FDA Food Contact Material Report Processing Guidelines
1、 Report applicable situations
The US FDA regulates food contact materials through 21 CFR Parts 170-199. When coffee cups (disposable paper cups, takeaway hot drink cups, cup lids, stirrers, etc.) are exported to the United States, an FDA food contact material testing report is usually required.
Typical applicable products:
Disposable paper cup/hot drink cup (including inner coating)
Cup lid (plastic/silicone)
Mixing rod/straw
Paper cup cover, external paper bag
coffee filter paper
2、 Core regulations and testing projects
Coffee cups mainly involve two categories of regulations: 21 CFR 176.170 (paper and cardboard) and 21 CFR 175.300 (coating):
|Test items | Test methods | Limits/requirements
|Total amount of extract (total migration) | Soaking in food simulants | Different limits for various simulants
|Antibacterial extract | 21 CFR 176.170 | Concentration constraint limits
|Fluorescent whitening agent | Specific extraction | Cannot migrate to food
|Heavy metal extraction | ICP/AAS | Meets specific limits
|PFAS (perfluorinated compounds) | LC-MS/MS | Key focus projects
|Bisphenol A (BPA) | Migration testing | Some states have banned it
|Specific migration substances | Depending on the material | Compliant with 21 CFR list
Selection of food simulants (represented by coffee):
10% ethanol (simulated water-based food)
50% ethanol (depending on product usage)
The testing temperature and time are determined according to the actual usage scenario (such as hot coffee at around 70-90 ° C)
3、 Handling process
1. Preliminary preparation
Provide product material, structure, and coating type (PE/PLA/water-based coating)
Confirm the coating weight and printing ink information
Confirm the testing checklist with downstream American customers (some brands have additional requirements)
2. Sample requirements
Complete product: usually 20-30 complete coffee cups
Accessories such as cup lids/mixing bars need to be separately sampled
Different colored items need to be inspected separately by color
3. Laboratory testing
Choose an ISO 17025 accredited laboratory
Dezewei Testing CNAS Registration Number: L8083
4. Issue a report
Provide an English version of the testing report
The report includes: testing methods, testing results, regulatory evaluation conclusions
Cooperate in issuing a Declaration of Conformity (DoC) to facilitate import customs clearance
4、 Special precautions
1. PFAS control upgrade
Starting from 2024, multiple states in the United States, such as New York, California, and Washington, have implemented bans and restrictions on fluorinated compounds
Coffee cups with oil/water resistant coatings belong to high-risk categories
Suggest using water-based PLA or bio wax coating as a substitute
2. Cup lid and stirring rod
If the cup lid and stirring rod are made of plastic material, an additional 21 CFR 177.1520 (polyolefin) or corresponding polymer test must be performed
Suggest sending it for inspection together with the cup body to avoid incomplete reports
3. Validity period of the report
The FDA does not specify a fixed validity period for reports, but industry practice is one year
Re testing is required after changes in formula, process, or raw materials
4. Additional customer requirements
Brands such as Starbucks and McDonald's often require testing for phthalates and formaldehyde PFAS、 Bisphenol A and other projects
Suggest clarifying the testing checklist with the customer before sending for inspection
5、 Cost and cycle reference
|Service type | Cost range | Cycle
|Basic items (extract+heavy metals) | 800-2000 yuan | 5-7 working days
6、 Compliance recommendations
Consider California Prop 65 simultaneously: Coffee cup printing ink may contain lead and cadmium, and must comply with California warning requirements
Same as exporting to the EU at the same time: it is recommended to apply for LFGB/EU food contact material testing together to avoid duplicate sample submission
Recycled paper materials: If using recycled fibers, extra attention should be paid to residual pollutants such as polychlorinated biphenyls and dioxins
